For Delaying Flight, Court Orders Airline To Pay Passenger N10million
For delaying a flight, a court has ordered Arik Airline to pay a passenger the sum of N10million
A Federal Capital Territory (FCT) High Court delivered the judgement yesterday.
The passenger, Isa Modibbo, who is diabetic. He reportedly missed an appointment with his doctor in Sokoto. This was after his flight from Abuja was delayed. The flight which was scheduled for 10:30 a.m. was delayed to 6 p.m. on December 16, 2017.
Dissatisfied with the airline’s action, Modibbo proceeded to file a suit against the airline for “infringing on his human rights”.
The presiding Judge, Justice Danlami Senchi gave the ruling. He held that the failure of the airline to fulfil its contractual obligation of airlifting the plaintiff to Sokoto from Abuja at the stipulated time.
Senchi further held that the failure of the airline to respond to the request of the plaintiff for compensation due to the willful infringement “was a display of sheer arrogance which must not be allowed to continue.” The court orders
Arik Air is a Nigerian airline operating mainly from two hubs in Nigeria. The airline serves a network of regional and mid-haul destinations within Africa.
