LASG Appeals Judgement Stopping LASTMA From Towing Vehicles, Imposing Fines
LASG has appealed a court judgement stopping LASTMA officials from towing vehicles and imposing fines.
A court judgment on Sept. 22nd held that LASTMA couldn’t impose fines and tow vehicles without a valid court order.
In the court judgment, a judge also awarded N750k damages against LASG for violating the fundamental right of a lawyer.
The lawyer, whose vehicle was towed away by LASTMA, was forced to pay N20,000 fine as well as N10k towage fine.
LASG advised members of the public to be law abiding and ensure compliance with all relevant Laws of the State.
The Lagos State Government has filed a notice of appeal against a court judgement stating that the Lagos State Traffic Management Authority (LASTMA) could not impose fines or tow vehicles without a valid court order.
The notice of appeal, filed by the the State Government on 30 September, contains four grounds against the judgement of a judge, Mr Olalekan Oresanya, delivered on 22 September, 2022.
While revealing the move in a press release on Wednesday October 5th, the Lagos State Government advised members of the public to be law abiding and ensure compliance with all relevant Laws of the State.
Court Bars LASTMA From Towing Vehicles, Imposing Fines
In a court judgment last month, Olalekan Oresanya of an Ikeja High Court, held that LASTMA could not impose fines and tow vehicles of suspected traffic offenders without an order of a court of competent jurisdiction.
Mr Oresanya also awarded N750,000 damages against the State Government for violating the fundamental right of a lawyer, Lawal Aliyu, whose vehicle was towed away by LASTMA officers.
Following the vehicle confiscation, LASTMA officials forced Lawal Aliyu to pay a fine of N20,000 for an alleged traffic offence as well as imposed N10,000 towage fine.
