Petronella And Innoson At War, Oil Firm Says ‘IVM Granites’ Supplied Didn’t Meet Its Specifications
Innoson Vehicle Manufacturing (IVM), Petronella Nigeria Limited at war over N430m million vehicle supply contract.
Petronella claimed that out of the 20 vehicles order, only eight was delivered and non of them met its specifications.
Reacting to the allegation, Innoson Motors accused Petronella of keeping its vehicles and wanting a refund.
It added that it met the specifications and standard of vehicles Petronella Nigeria Limited requested for.
Petronella (Nig) Limited has dragged Innoson Vehicle Manufacturing (IVM) Company to the Federal Competition and Consumer Protection Commission (FCCPC) over the brand’s refusal to supply the vehicles it purchased worth N430 million.
In the petition signed by a lawyer Olaniwun Ajayi, Petronella claimed that it paid a total of N415 million out of a total sum of N430m million it agreed with IVM management for the supply of 20 units of “IVM’s five-seater pickup truck.
The petitioner claimed that out of the twenty vehicles order estimated at N415 million, only eight was delivered and non of them met its specifications.
Part of the petition dated 10th January 2023, reads :
“Despite having received about N415 million from Petronella by 29 October 2021 for twenty units of the IVM Granite, IVM did not deliver the vehicles within the two-week timeframe that it had promised.
“When IVM finally delivered vehicles to Petronella, it delivered only nine vehicles, one of which it immediately retrieved because of a defect in the engine, so that Petronella was ultimately left with eight vehicles but of the twenty that IVM had agreed to supply. IVM never delivered the remaining twelve vehicles.
“Crucially, the vehicles that IVM delivered did not meet the specifications that IVM had represented that they would meet. Specifically, the vehicles did not possess a five-star NCAP rating.
“When Petronella requested an NCAP crash test report, IVM did not provide one; instead, IVM forwarded by email a document that had the appearance of a crash test report, but which gave no indication that it had been issued by a crash testing authority.
Reacting to the allegation, IVM accused Petronella of keeping its vehicles and wanting a refund. It added that it met the specifications and standard of vehicles Petronella Nigeria Limited requested for.
A statement by Head of Corporate Communications, Cornel Osigwe, reads :
“Our attention of IVM has been drawn to a false media report currently circulating in some social media platforms, which is highly misleading, ordinarily we would have ignored the report since the matter is already in the court, but because the content of the report may mislead our hard-earned clients and prospects, we were left with no other option than to address it for record purposes.”
“It is now an incontrovertible fact that Innoson Vehicles manufactures durable and affordable vehicles that meet international specifications. The unique thing about Innoson Vehicles is that its vehicles come with the basic specifications and the vehicle plant has the capacity to increase the specifications needs of a client.”
“As regards our client, Petronella Nig Ltd which ordered 20 Units of Granite Diesel Pick Ups, We met the standard and basic specifications it demanded from us and provided every certification it requested for.”
“On our receipt of the part payment made by Petronella Nig Ltd, we supplied the first set of the vehicles to Petronella and it took delivery of them from our factory in Nnewi with a view that the remaining quantity will be supplied to it once we receive the outstanding purchase price.”
“After a while, surprisingly, rather than pay their outstanding, Petronella said it was returning the ones it took delivery of. Then given that we trust our quality and standard and that the vehicles are in high demand, we asked Petronella to return the vehicles to our factory in Nnewi so we will refund the purchase price it paid.”
“However, up till this day, these vehicles are still in possession, and custody of Petronella and it has refused to return them to us as said above. We are willing to refund Petronella the purchase price once it returns these vehicles to us stated earlier, perhaps given the passage of time in the state they were in when it took delivery of them.”
“Petronella Nig Ltd for whatever reason choose to approach the law court, we urge Petronella to allow wise counsel to prevail as we value each of our clients and treat them with the utmost respect.”
