For Stealing Diesel, Court Sentences Driver To Five Years In Prison

Musa Nureni, 43, was sentenced to five years in prison by a Magistrate Court in Akure, Ondo State’s capital, for stealing 60 litres of diesel worth N42,000.

Nureni, who was charged with Njimi Peter, the victim of the theft, committed the crime on April 15, 2022, at Oremeji Sawmill, Ondo, Ondo West Local Government Area, Ondo State.

The two defendants were charged with theft and receiving stolen items on two counts.

Nureni was caught by the complainant, Akin Kayode, while attempting to sell the diesel, according to the prosecutor, Benard Olagbayi.





Sections 516, 427, and 390(9) of the Criminal Code, Cap 37, Vol. 1, Laws of Ondo State, 2006, are violated.

The charge read in part,” That you Musa Nureni and Njima Peter on the same date, time and place in the aforementioned Magisterial District did steal 60 litres of diesel valued atvN42,000, property of one Akin Kayode and thereby committed an offence contrary to and punishable under Section 390(9) of the Criminal Code Cap 37 Vol. 1 Laws of Ondo State of Nigeria 2006.

“That you, Njima Peter on the same date, time and place in the aforementioned Magisterial District did receive 60 litres of diesel valued N42,000 knowing fully to have been stolen or obtained and thereby committed an offence contrary to and punishable under section 427 of the criminal code cap. 37 vol. 1 law of Ondo State of Nigeria 2006.

Nureni however, pleaded guilty to the charges levelled against him while Njimi pleaded not guilty.

Mr O.A Akinbinu, counsel for the defendants, requested the court to show mercy to Nureni because he did not waste the court’s time by pleading guilty and applied for bail for Njimi in the most liberal conditions possible.

Mrs Charity Adeyanju, the Presiding Magistrate, sentenced Nureni to five years in jail on both counts, with the option of a N150,000 fine.
